Privacy Policy

This policy applies to the First Take websites, applications, AI tools, creation and publishing workflows, communications, and related services (collectively, the “Service”). “Delos,” “we,” “us,” and “our” mean Delos Studios and its affiliates. This policy does not govern a third party's independent handling of information through a service, website, or account that it controls.

Depending on how you use the Service, we may collect:

• Account and contact information, such as your name, email address, authentication identifiers, account role, invitation, subscription, preferences, and communications with us.
• User Content and project information, including prompts, instructions, scripts, conversations, images, video, audio, voice samples, reference materials, generated outputs, project files, publishing packages, feedback, and related metadata. User Content may include personal information about you or other people.
• Transaction and usage information, such as plan, credit, purchase, generation, storage, and provider-usage records. Payment processors generally collect payment-card details directly; we receive transaction, subscription, and payment-status information needed to administer your account.
• Connected-service information. If you connect or use a third-party account or publishing destination, we may receive account and channel identifiers, authorization credentials, content and publication metadata, audience or performance information, and settings made available through that connection.
• Device, log, and diagnostic information, such as IP address, browser and device type, timestamps, requested routes, performance measurements, error reports, security events, and similar technical information.
• Derived information, such as content features, embeddings, evaluations, recommendations, audience and performance analyses, usage patterns, and other inferences or learnings generated from the information above.
• Public information, including public profile details, social links, published content and metadata, and public performance information.

Please do not submit regulated, confidential, or sensitive information unless we have expressly agreed in writing to process it. If you provide personal information about another person, you are responsible for having the rights and permissions required to do so.

We collect information directly from you; automatically from your browser, device, and use of the Service; from workspace owners, administrators, and collaborators; from authentication, payment, hosting, AI, media-generation, publishing, analytics, and other providers; from services you connect; and from public sources when needed for research, publishing, analytics, safety, or product features.

We may use information to:

• provide, operate, maintain, and support the Service;
• create, edit, analyze, store, retrieve, distribute, and publish content at your direction;
• authenticate users, administer accounts and invitations, process payments, apply usage limits, and maintain transaction and audit records;
• communicate about the Service, including account, security, support, payment, product, and legal notices;
• personalize workflows and generate recommendations, evaluations, analytics, and performance insights;
• evaluate, develop, train, tune, test, and improve the Service and related AI or machine-learning models, systems, products, and services as permitted by our Terms of Use;
• monitor reliability, investigate errors, enforce our terms and policies, prevent fraud or abuse, and protect users, Delos, providers, and the public; and
• comply with law, respond to lawful requests, resolve disputes, and establish, exercise, or defend legal claims.

We may disclose information to:

• Service providers and contractors that support hosting, private storage, authentication, email, payment, analytics, customer support, security, moderation, AI inference, media generation, and other operations.
• Connected services and publishing destinations when you ask us to import, analyze, generate, export, synchronize, or publish information through them. Their own terms and privacy practices may apply.
• Workspace participants. Owners and administrators may access, manage, export, reassign, publish, or delete workspace content and may control members' access. Collaborators may see information shared within their authorized workspace or project.
• The public or recipients you choose when you publish content, enable a public creator profile, share a link, or otherwise direct us to make information available.
• Authorities and other parties when reasonably necessary to comply with law, protect rights and safety, prevent fraud or abuse, enforce our agreements, or respond to legal process.
• Transaction participants and advisers in connection with an actual or proposed financing, merger, acquisition, reorganization, sale of assets, insolvency, or similar corporate event, subject to appropriate confidentiality protections where required.

During the preceding 12 months, these business-purpose disclosures have involved the relevant categories described in Section 2. We do not sell personal information or share it for cross-context behavioral advertising, and we have not done so during the preceding 12 months.

First Take uses third-party AI, model, and media providers to process prompts, User Content, references, and outputs for the feature you request. The provider and data sent depend on the model, workflow, or integration you select. We may also use User Content, performance information, feedback, and derived information to evaluate and improve First Take and related technology as described in our Terms of Use. Do not submit information that you are not authorized to provide or that requires special handling we have not agreed to in writing.

We use cookies, local storage, and similar technologies for authentication, session security, preferences, core functionality, fraud prevention, performance measurement, and error diagnosis. We do not use them for cross-context behavioral advertising. You can learn more in our Cookie Policy.

We retain information for as long as reasonably necessary to provide the Service, maintain and improve our systems, honor your choices, protect the integrity and security of the Service, comply with law and provider obligations, resolve disputes, enforce agreements, and keep legitimate business and audit records. Retention varies by the information, account status, feature, and legal requirement. Deletion requests may be limited by legal exceptions, backup cycles, security needs, other users' rights, and the rights and licenses described in our Terms of Use.

We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, or alteration. No system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting your credentials and promptly notifying us of suspected unauthorized access.

Depending on where you live and subject to applicable exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of your personal information; to opt out of certain sales, targeted advertising, or profiling; to withdraw consent where processing depends on consent; and to receive equal service without unlawful discrimination for exercising a privacy right. We do not currently sell personal information or use it for targeted advertising.

You may update certain information through your account or submit a request to legal@first-take.studio. Describe the right you want to exercise and the account involved. We may verify your identity and authority before completing a request. An authorized agent may submit a request where permitted by law, but we may require proof of authorization. If applicable law gives you a right to appeal our decision, reply to our response with “Privacy Appeal.”

The Service is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action.

Delos and its providers may process and store information in the United States and other countries where they operate. Privacy laws in those locations may differ from those where you live. Where required, we use appropriate safeguards for international transfers.

We may update this policy as the Service or law changes. We will post the revised policy and update the effective date. We may provide additional notice when a change is material or when required by law.
